{"id":226704,"date":"2022-09-26T07:52:40","date_gmt":"2022-09-26T06:52:40","guid":{"rendered":"https:\/\/jean-monnet-saar.eu\/?p=226704"},"modified":"2022-09-26T09:16:23","modified_gmt":"2022-09-26T08:16:23","slug":"prof-giegerichs-contribution-to-online-conference-on-turkey-eu-relations-hs-been-published","status":"publish","type":"post","link":"https:\/\/jean-monnet-saar.eu\/?p=226704","title":{"rendered":"Prof. Giegerich&#8217;s contribution to online conference on T\u00fcrkiye-EU Relations has been published"},"content":{"rendered":"\n<p>The papers of the online conference \u201cLegal Issues in T\u00fcrkiye \u2013 European Union Relations\u201d organized by the Jean Monnet Chair on Legal Issues in Turkey-EU Relations at the<strong>&nbsp;Law Faculty of Ankara University<\/strong>(Prof. Dr. \u0130lke G\u00f6\u00e7men) in which&nbsp;<a href=\"https:\/\/jean-monnet-saar.eu\/?paged=4\" target=\"_blank\" rel=\"noreferrer noopener\">Prof. Giegerich participated<\/a>&nbsp;on 17 March 2022 have just been published in e-book format by Ankara \u00dcniversitesi Basimevi. The volume is accessible&nbsp;<a href=\"http:\/\/litreur.ankara.edu.tr\/wp-content\/uploads\/sites\/935\/2022\/09\/Legal-Issues-In-Turkiye-European-Union-Relations-Teblig-Kitabi.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>. The volume includes Prof. Giegerich\u2019s paper on \u201cCommon but Differentiated Responsibilities of T\u00fcrkiye and the EU in Relation to Irregular Migration\u201d (pp. 65 \u2013 79). His conclusion is as follows (p. 79):<\/p>\n\n\n\n<p>\u201cConclusion: CbDR Minus in the EU-TR MMP [Migration Management Partnership]<\/p>\n\n\n\n<p>The EU-T\u00fcrkiye MMP with various hard-law and soft-law components is characterised by a number of elements reminiscent of the altruistic principle of CbDR which is firmly established in international environmental law. However, the special legal and political relationship between the EU and T\u00fcrkiye, based on the Ankara Agreement and the latter\u2019s application for EU membership, intersects with the MMP and introduces egoistic elements into the partnership that seem to dominate the altruistic CbDR elements. The EU-T\u00fcrkiye MMP is thus characterised by a reduced CbDR version that may be called \u201cCbDR Minus\u201d. Progress in the further development of the MMP will depend more on calculations of national interests on both sides than by the altruistic CbDR principle.
