{"id":2369,"date":"2019-12-09T16:32:31","date_gmt":"2019-12-09T14:32:31","guid":{"rendered":"https:\/\/jean-monnet-saar.eu\/?p=2369"},"modified":"2019-12-09T16:32:31","modified_gmt":"2019-12-09T14:32:31","slug":"zeus-4-19-ist-erschienen","status":"publish","type":"post","link":"https:\/\/jean-monnet-saar.eu\/?p=2369","title":{"rendered":"ZEuS 4\/19 ist erschienen"},"content":{"rendered":"<p>Im gerade erschienen Heft 4\/19 der <a href=\"https:\/\/europainstitut.de\/lehre-forschung\/publikationen\/zeus\">Zeitschrift f\u00fcr Europarechtliche Studien<\/a> sind zwei Beitr\u00e4ge von Angeh\u00f6rigen des Jean-Monnet-Lehrstuhls ver\u00f6ffentlicht worden.<\/p>\n<p>Prof. Dr. Thomas Giegerich has published a paper on the question \u201cCan German Courts Effectively Enforce International Legal Limits on US Drone Strikes in Yemen?\u201d (pp. 601 \u2013 624).<\/p>\n<p><em>Abstract<\/em>: A German Administrative Court of Appeal has attempted to enforce international legal limits on US drone strikes in Yemen against suspected senior leaders of international terrorist organisations. These strikes are conducted via a satellite relay station located at the US Air Base in Ramstein, Germany. In a judgment that is not final \u2013 an appeal to the Federal Administrative Court is pending \u2013 the Court stopped short of ordering the German Federal Government to prohibit the US from using Ramstein Air Base for drone strikes in Yemen altogether. However, the Court ordered the defendant to ensure by appropriate action that the US, when making use of its Ramstein Air Base for such strikes, fully complied with public international law, as further specified in the grounds of the judgment. The grounds provide a textbook presentation of the <em>jus ad bellum<\/em> and <em>jus in bello<\/em> standards for targeted killings by drones in foreign territory, in particular those deriving from international humanitarian law and international human rights law. The Court considered it proven that the targeting standards used by the US were not fully compatible with IHL and IHRL. The German Court\u2019s approach is strikingly different from the judicial abstentionism practiced by US federal courts in those cases. It put a thorough judicial scrutiny of the US drone strike practice on public record, taking the place of an international court \u2013 which is absent for lack of jurisdiction. Yet, it exercised judicial restraint, leaving the German Federal Government enough room for manoeuvre to maintain good political and military relations with the US while at the same time increasing the pressure of public opinion on the German accomplice and to a lesser extent on the US principal offender toward future compliance with international law.<\/p>\n<p>Katharina Koch, LL.M. besch\u00e4ftigt sich mit der Frage &#8222;Ist der partielle Entzug des Sorgerechts zur Durchsetzung des Schulpflicht konventionsm\u00e4\u00dfig? Eine Analyse der Entscheidung <em>Wunderlich v Germany&#8220; <\/em>(S. 555-572).<\/p>\n<p><em>Abstract<\/em>: In der Entscheidung <em>Wunderlich v Germany<\/em> wurde der Europ\u00e4ische Gerichtshof f\u00fcr Menschenrechte (EGMR) gefragt, ob der partielle Entzug des elterlichen Sorgerechts zur Durchsetzung der Schulpflicht rechtm\u00e4\u00dfig war. Eltern christlichen Glaubens hatten ihre Kinder nicht in eine staatliche Schule geschickt. Da die von den zust\u00e4ndigen Beh\u00f6rden verh\u00e4ngten Sanktionen nicht erfolgreich waren, entzogen diese f\u00fcr drei Wochen das Sorgerecht der Eltern. Darin sahen die Eltern eine Verletzung ihres durch Art. 8 EMRK gesch\u00fctzten Rechts auf Familienleben. Dies f\u00fchrt zun\u00e4chst zur Frage, ob die Schulpflicht als solche konventionsm\u00e4\u00dfig ist, was vom EGMR in vorherigen Entscheidungen bereits bejaht wurde. Dies bedeutet aber nach Rechtsprechung des EGMR nicht, dass Sch\u00fclerinnen und Sch\u00fcler jedes Fach besuchen m\u00fcssen. Vielmehr muss die M\u00f6glichkeit einer Befreiung von einzelnen F\u00e4chern bestehen.
