Im ersten Schritt werden die Konditionalit\u00e4tsmechanismen dargestellt, die der EU zur Verf\u00fcgung stehen, um die Freigabe finanzieller Mittel aus rechtsstaatlichen Erw\u00e4gungen zu verweigern. Die Autorin w\u00fcrdigt die Freigabeentscheidung der EU vom 13. Dezember des vergangenen Jahres aus rechtlicher Sicht. Im zweiten Schritt wird die Frage untersucht, inwiefern tats\u00e4chlich eine rechtsstaatliche Verbesserung in Ungarn zu erkennen war, die eine Mittelfreigabe rechtfertigt. Daraufhin wagt Frau Freymann eine Einsch\u00e4tzung der Bedeutung der Freigabeentscheidung f\u00fcr die Zukunft des Rechtsstaatlichkeitsmechanismus in der EU.<\/p>\n\n\n\n<p>***<\/p>\n\n\n\n<p>In our new <strong><a href=\"https:\/\/jean-monnet-saar.eu\/wp-content\/uploads\/2024\/05\/Saar-Blueprint_Marie-Sophie-Freymann.pdf\">Saar Blueprint<\/a><\/strong>, Marie-Freymann addresses the release of funds from the Cohesion Fund by the European Union (EU) and its implications for the future of the EU rule of law mechanism. First, the conditionality mechanisms available to the EU to refuse the release of financial resources when a Member State breaches principles of the rule of law are presented. The author then assesses the EU&#8217;s release decision of December 13 of last year from a legal perspective. She examines the extent to which an improvement in the acceptance of rule of law standards could actually be recognized in Hungary that would justify the release of funds.
