Unter dem Titel „Entsch\u00e4digungsanspr\u00fcche von Grenzg\u00e4ngern in Corona-Quarant\u00e4ne – \u00a7 56 Infektionsschutzgesetz aus unionsrechtlicher Sicht“ ist soeben ein Beitrag von Univ-Prof. Thomas Giegerich in Heft 2\/2021 der Zeitschrift f\u00fcr europarechtliche Studien (ZEuS) publiziert worden. Im Abstract wird der Inhalt des Beitrags auf Deutsch und Englisch folgenderma\u00dfen zusammengefasst: Nach \u00a7 56 Abs. 1 Satz 2 IfSG enth\u00e4lt eine Arbeitnehmerin, gegen die aufgrund des IfSG Quarant\u00e4ne verh\u00e4ngt wird und die dadurch einen Verdienstausfall erleidet, eine Entsch\u00e4digung in Geld von dem deutschen Land, das die Quarant\u00e4ne-Ma\u00dfnahme getroffen hat. Dieser Entsch\u00e4digungsanspruch, der weder an die Staatsangeh\u00f6rigkeit noch den Arbeitsort ankn\u00fcpft, beruht auf Billigkeitserw\u00e4gungen und soll die betroffenen Arbeitnehmer von materieller Not bewahren. Seine Einf\u00fchrung erfolgte freiwillig ohne verfassungs-, v\u00f6lker- oder europarechtliche Verpflichtung. Einer Arbeitnehmerin, gegen die eine EU-ausl\u00e4ndische Beh\u00f6rde auf EU-ausl\u00e4ndischer Rechtsgrundlage Quarant\u00e4ne verh\u00e4ngt hat, steht der Anspruch aus \u00a7 56 Abs. 1 Satz 2 IfSG nicht zu (m\u00f6glicherweise aber ein entsprechender Anspruch nach dem EU-ausl\u00e4ndischen Recht). Diese Begrenzung von Anspr\u00fcchen aus \u00a7 56 Abs. 1 Satz 2 IfSG auf deutsche Quarant\u00e4ne-Ma\u00dfnahmen verst\u00f6\u00dft weder gegen das Sekund\u00e4rrecht noch das Prim\u00e4rrecht der EU. Die Mitgliedstaaten k\u00f6nnen ihre Praxis bei der Entsch\u00e4digung der Adressaten von Quarant\u00e4ne-Ma\u00dfnahmen freiwillig aufeinander abstimmen, um einer Ungleichverteilung des Lohnrisikos in grenz\u00fcberschreitenden F\u00e4llen und insbesondere im grenznachbarlichen Kontext \u00fcber das unionsrechtlich Gebotene hinaus entgegenzuwirken. Sie m\u00fcssen dabei die Angeh\u00f6rigen aller Mitgliedstaaten, die sich in der gleichen Lage befinden, gleich behandeln, k\u00f6nnen aber auf Reziprozit\u00e4t bestehen.<\/p>\n\n\n\n

Compensation Claims of Frontier Workers in Corona Quarantine: Sec. 56 of the German Infection Protection Act from an EU Law Perspective<\/p>\n\n\n\n

Pursuant to Sec. 56 (1) sentence 2 of the German Infection Protection Act, a worker against whom quarantine is imposed on the basis of that Act and who suffers a loss of earnings as a result is entitled to monetary compensation from the German Land that imposed the quarantine. This compensation claim, which is not linked to nationality or place of work, is based on considerations of equity and is intended to protect the affected workers from material hardship. It was introduced voluntarily without any obligation under constitutional, international or Union law. A worker against whom the authority of another EU Member State has imposed quarantine based on the national law of that Member State cannot claim compensation under Sec. 56 (1) sentence 2 of the German Act (but possibly under a similar provision of that national law). This limitation of compensation claims under Sec. 56 (1) sentence 2 to German quarantine measures violates neither secondary nor primary EU law. The Member States may voluntarily coordinate their practice in compensating the addressees of quarantine measures in order to counteract an unequal distribution of the wage risk in cross-border cases and especially in the cross-border neighbourhood context beyond what is required by EU law. In doing so, they must treat nationals of all Member States who are in the same situation equally, but may insist on reciprocity.<\/p>\n","protected":false},"excerpt":{"rendered":"
