Menschenrechtsrisiken in KI-Systemen und der Balanceakt regulatorischer Maßnahmen: Eine Analyse des Spannungsfelds zwischen Menschenrechtsförderung und -gefährdung am Beispiel der KI-Verordnung der EU und des Rahmenübereinkommens des Europarats

Künstliche Intelligenz birgt erhebliche Chancen für den Menschenrechtsschutz, wirft zugleich aber neue Risiken für Freiheit, Gleichheit und demokratische Teilhabe auf. Der Saar Blueprint untersucht, wie Europa diesen Herausforderungen regulatorisch begegnet, analysiert das Rahmenübereinkommen des Europarats und die KI-Verordnung der EU und ordnet beide Ansätze in den globalen Kontext der Regulierungsstrategien der USA und Chinas ein. Im Mittelpunkt steht die Frage, wie wirksam die europäischen Schutzmechanismen tatsächlich sind und wo trotz normativer Klarheit weiterhin Lücken und Spannungen zwischen Grundrechtsschutz, Innovation und Wettbewerbsfähigkeit bestehen.

The contribution explores what remains of the EU AI Act’s original promise in light of the Digital Omnibus proposal. By tracing the tension between ambition, simplification, and democratic governance, it asks whether the EU still offers a coherent vision for regulating AI and what may be at stake if it does not.

Die Saar Case Note von Eva Ghazari-Arndt beleuchtet, wie sich präventiver Rechtsschutz und Schadensersatz bei immateriellen Schäden im System der DSGVO zueinander verhalten. Ausgangspunkt ist ein Bewerbungsverfahren, in dem vertrauliche Informationen versehentlich an eine unbeteiligte dritte Person gelangten – mit spürbaren Folgen für den Betroffenen. Anhand des EuGH-Urteils vom 04.09.2025 (C-655/23) wird gezeigt, welche Maßstäbe für die individuelle Rechtsdurchsetzung im Datenschutzrecht künftig prägend sein können.

It reflects on the enduring transatlantic significance of the rule of law and the deep influence of U.S. constitutional ideas on German constitutional thinking. With the United States approaching the 250th anniversary of the Declaration of Independence in 2026, it asks what is at stake for constitutional democracy today.
