In unserem neuen Saar Blueprint wird das Urteil des EGMR vom 23. Mai 2024 analysiert, das die strafrechtliche Verantwortung des ehemaligen georgischen Präsidenten Mikheil Saakashvili für die Ausübung seines Begnadigungsrechts betrifft, der aus politischen Gründen wegen Mordes verurteilte Straftäter begnadigte.
Ein sehr lesenswerter Beitrag im Bereich des internationalen Strafrechts und des europäischen Menschenrechtsschutzes!
Der EGMR entschied im Fall Pietrzak und Bychawska-Siniarska gegen Polen, dass die polnischen Regelungen zur verdeckten Telekommunikationsüberwachung, der Vorratsdatenspeicherung und des Antiterrorgesetzes gegen Art. 8 EMRK verstoßen. Das Urteil setzt hohe Maßstäbe für staatliche Überwachungsmaßnahmen und könnte auch für das deutsche Recht Reformbedarf nach sich ziehen.
