It reflects on the enduring transatlantic significance of the rule of law and the deep influence of U.S. constitutional ideas on German constitutional thinking. With the United States approaching the 250th anniversary of the Declaration of Independence in 2026, it asks what is at stake for constitutional democracy today.

Auf der gemeinsamen Tagung der Universitäten Basel und Innsbruck in Zürich am 16. Mai 2025 betonte Prof. Giegerich die Notwendigkeit, die Begriffe „Europarechtsfreundlichkeit” und „Integrationsverantwortung” aufeinander zu beziehen und dabei die Verantwortung deutscher Verfassungsorgane – einschließlich des BVerfG – positiv auf das Gelingen der europäischen Integration auszurichten. Er schlug vor, die Europarechtsfreundlichkeit als Ausdruck der Rechtsstaatlichkeit in Art. 79 Abs. 3 GG zu verankern.
