The contribution explores what remains of the EU AI Act’s original promise in light of the Digital Omnibus proposal. By tracing the tension between ambition, simplification, and democratic governance, it asks whether the EU still offers a coherent vision for regulating AI and what may be at stake if it does not.

Die Saar Case Note von Eva Ghazari-Arndt beleuchtet, wie sich präventiver Rechtsschutz und Schadensersatz bei immateriellen Schäden im System der DSGVO zueinander verhalten. Ausgangspunkt ist ein Bewerbungsverfahren, in dem vertrauliche Informationen versehentlich an eine unbeteiligte dritte Person gelangten – mit spürbaren Folgen für den Betroffenen. Anhand des EuGH-Urteils vom 04.09.2025 (C-655/23) wird gezeigt, welche Maßstäbe für die individuelle Rechtsdurchsetzung im Datenschutzrecht künftig prägend sein können.

This contribution is the extended version of Thomas Giegerich’s welcome remarks opening an introductory course to U.S. law in Saarbrücken. It reflects on the enduring transatlantic significance of the rule of law and the deep influence of U.S. constitutional ideas on German constitutional thinking. With the United States approaching the 250th anniversary of the Declaration of Independence in 2026, it asks what is at stake for constitutional democracy today.
